Wills and Administrations:

Return to Data / Document Index !
Prior to 1850, and the introduction of a detailed Federal Census, wills, and other documents providing for the distribution of property, are often the only positive means of determining the relationships between individuals. Parents leave specific property to their sons, identifying lineage; to their married-daughters, identifying ther married-name; to their children "not yet of age", identifying a range for birth-years; to their "grandchildren", connecting 3-generations in a single document. These documents provide insight through the type of property they transfer -- indicating what was of value to the Devisor; the quantity of property they transfer -- indicating the relative wealth of the Devisor; the location of the property -- helping to pin down where the Devisor lived; and sometimes the prior owner of a parcel -- helping to determine when a property was acquired, or how long the Devisor has lived in a particular area.

Wills exist in at least two, and sometimes more, forms: there is:

  • (1) the original, personal copy of the will, produced and retained by the individual;
  • (2) the first recording, the hand-copied version recorded in County-of-residence records by the local Clerk, usually at the time of the individuals death and probate; and
  • (3) recordings, additional hand-copied versions in State records or the records of other Counties where the individual may have owned property, and where a record of its disposition was made, usually done after the death of the individual.
The County copies are often the only remaining source for these records. Ocassionally an original Will has been retained by descendents or is available from State archives.

This collection has been developed from several sources, and in some fortunate situations, has used both original and Clerk's copies of the will to compare and clarify the spelling and intent of the will. For the most part, the sentence structure and spelling are from the original document. The documents are presented in full, and bold names are added to help locate heirs and determine relationships between individuals mentioned in the will. They are collected in chronological order, as to the date they were written, or if unknown, the date they were entered for Probate by the Clerk of Court.
